That’s why he’s in trouble – Ekstra Bladet
Lawyer Tyge Trier is in no doubt that David Jarsbo may have to pay Sille Nilholm half of the prize money from ‘Paradise Hotel’

On Thursday, Ekstra Bladet reported that David Jarsbo still does not intend to pay his ex-girlfriend Sille Nimholm 250,000 kroner, even though it was his promise to her.

You can not just run from an agreement, even if it is an oral one of a kind, points out lawyer Tyge Trier to Ekstra Bladet.

– It is established law in Denmark that oral agreements are as binding as written agreements. However, she has the burden of proving that he has given her the oral promise, he says and continues:

– If he has stated it publicly in a precise and comprehensible manner, and there are no concrete conditions for it, then the starting point is legal that he is bound by the commitment given to her. She should have a good chance, but it must be assessed concretely.

Tyge Trier further explains that Sille has the opportunity to motivate David to pay her by encouraging his lawyer to send a letter to David stating that there will be interest on the amount – exactly eight percent per year, if he does not begin to shell out.

– If she starts to set the interest rate meter in motion, then it may motivate him to pay. It is called a demand, the lawyer says.

See you in court
However, David Jarsbo does not give up without a fight.

– There are several things in it, things that have been written and pronounced subsequently. I have a lawyer myself, so there is not much else to say but that we will see each other in court, David writes in a short message to Ekstra Bladet.

An oral agreement is as binding as a written agreement. However, it requires proof that the agreement has been entered into, and it is not as easy to prove an oral agreement as a written agreement.

This is, among other things, with reference to the Contracts Act § 3 para. 2, which reads:

‘Tenders submitted orally without a time limit for acceptance must be accepted immediately.’
