Nyrstar cleared of prosecution in Brussels

The dismissal of prosecution can still be challenged on appeal. The decision follows a civil complaint from several small Nyrstar shareholders in 2019 against the course of events at Nyrstar prior to the takeover of the zinc activities in 2019 by the Singaporean commodity trader Trafigura. They argue that Trafigura deliberately weakened Nyrstar from within in order to incorporate it. Their struggle has been going on for more than five years, but has not yielded much until now.

Criminal law will not change much for Nyrstar as a result of the decision. Criminal investigations are also underway in Mechelen and Antwerp. In Antwerp, the file was scaled up to a judicial investigation earlier this year by demanding the appointment of an investigating judge.
