High tension with the robes on the migrant case. Nordio: "Abnormal sentence, we will intervene"

Tension is rising between the government and the judiciary, after the ruling of the Rome court which did not validate the transfer and detention of 12 migrants in the center just built in Albania. A decision harshly criticized by the government, with the Prime Minister Giorgia Meloni who defined it as “prejudicial”, announcing a meeting of the Council of Ministers for Monday which will serve to find “a solution”. And on the day of the expected return of the migrants to Italy, the majority and the executive do not take steps backwards, on the contrary, the tone is raised. It is the Keeper of the Seals himself who speaks bluntly of “abnormal sentences” and of a judiciary that “exceeds its powers”. While the deputy prime minister Matteo Salvini urgently brings together the leaders of the League and announces a mobilization against “the attack on Italy and Italians launched by a politicized part of the judiciary”. The opposition forms a wall and stigmatizes the clash waged by the executive against an “autonomous and independent power”.

Nordio announces “legislative measures”

The secretary of the Democratic Party, Elly Schlein warns: “No one is above the laws, least of all the government.” While waiting to understand how the Council of Ministers will move on Monday (the hypothesis is a decree law, therefore immediately operational, which intervenes on ‘safe countries’), the head of Justice Carlo Nordio confirms that “we will intervene with legislative measures”. Nordio began: “As a former magistrate I would consider it almost sacrilegious to think that the government to which I belong declares war on the judiciary, as it is not and never will be”. Having said this, “if the judiciary exceeds its powers, as in this case by attributing prerogatives such as that of defining a safe state, then politics must intervene, because politics expresses the popular will”. In short, he underlines, the government’s reaction to the sentence “is not against the judiciary, but against the merit of this sentence”, “a sentence that not only do we not agree with but we even consider it abnormal”. “These are high political issues that should not be left to the judiciary and will not be left to the judiciary”, finally assures the Keeper of the Seals.

The Dem leader has a completely different opinion and judges that “the institutional clash fueled by the government against the judiciary to cover up their inability is very serious. It is not the fault of the judges or the opposition if they do not know how to read the laws and sentences”. The secretary of the Democratic Party arrives at the paradox: “Let them not think they can circumvent the ruling because to circumvent a ruling from the Court of Justice of the EU they would have to leave the European Union”.

After the words spoken by Nordio, the Democratic Party asks for his resignation, because “in a democratic country, whose democratic and civil life is regulated by a Constitution, a Minister of Justice who launches such a heavy attack on the judiciary and its independence cannot stay in place.” But the majority has no doubts: “What has happened is very serious. There must be immediate responses” because “we are faced with a political clash. And the government has every right to implement its programme, weighing every decision and arguing it in a very serious, without being intimidated”, says the president of the senators of Forza Italia, Maurizio Gasparri. For the head of the Fratelli d’Italia delegation at the European Parliament, Carlo Fidanzathe sentence of the Rome court “is a shameful decision”, “it is not up to the judiciary to define which countries are safe and which are not, it is up to national governments”.

Second Maurizio Lupi “criticizing a ruling that is at least creative on a strategic provision for the government on the management of migratory flows is not opening an institutional clash. Rulings are respected, but they can be criticized”. But “what robes for the opposition, but what an obstacle to government action: the truth is that Meloni and Salvini, like the entire populist right, think that the government is above the law or is itself the law”, he observes on the contrary, the secretary of Più Europa Riccardo Magi. “We are not in feudalism, the Meloni government instead of attacking the judiciary and delegitimizing it, respects the laws”, adds the green Angelo Bonelli. “This is not a clever conspiracy, a mysterious Spectre, but the application of rules, guarantees and rights by responsible bodies”, explains the group leader of IV Enrico Borghi. “What is happening in these hours, with this direct attack on the judiciary made by the prime minister and vice prime minister, is of absolute gravity, because they want to question the principles and values ​​of our Constitution”, comments the leader of the CGIL Maurizio Landini.
