The judge communicates this “serious accusation” to the Dean Court
The defense of producer Nacho Cano has denounced that he was “surprisingly” assigned to the judge who is also investigating the proceedings against the partner of the president of the Community of Madrid, Isabel Díaz Ayuso.
This is stated in a ruling from the judge of the investigating court number 19 of Madrid, to which Europa Press has had access, and which includes the complaint from Cano’s defense, something that “would be violating” the predetermined ordinary procedure guaranteed by the law. .
The ruling states that according to Nacho Cano, the police report delivered to the deanery of Plaza Castilla “was not digitized, it was delivered on paper” and a “direct delivery to the investigating court number 19 of Madrid, the same one that surprisingly instructs the proceedings against Ayuso’s partner and the one who “was waiting for police actions from the Leganitos Police Station.”
Furthermore, according to the producer, on the day he was arrested, and as later published in the media, “it was already known which court and which magistrate was going to be in charge of investigating the case.”
“In this way, our right to the ordinary judge predetermined by law would be violated. If the distribution official of the deanery of Plaza de Castilla distributed the matter to a Court that did not correspond, it is an action perfectly accreditable through a computer expert” , Cano’s defense has indicated.
In response to the accusation, Judge María Inmaculada Iglesias Sánchez has informed the Ministry and the rest of the parties to formulate allegations within a period of five days.
“In view of the serious accusation that is being made in the document regarding the application of the rules for the distribution of matters between the Courts of Investigation of Madrid, with violation of the right to the predetermined judge by distributing the matter to this Court of Instruction no. 19 of Madrid, please inform the Senior Court of the appropriate effects,” he concluded.
