In front of dozens of doctors and participants: a 45-year-old woman from the center of Haaretz filed a claim for NIS 2.5 million against a dentist who performed cosmetic treatment on her during a conference. The claim – the procedure scarred her face and caused damages that will stay with her for life.
The woman says that the doctor assured that it was a “completely safe” treatment, except for a slight redness that should have passed in a short time. In practice, she felt that her face was on fire, suffered from burns, swelling, scabs and dark spots that spread over her forehead and cheeks.
According to the lawsuit, filed this month by attorney Ran Shapira, an expert in medical malpractice, the treatment was performed during a conference of dentists, where the doctor demonstrated the procedure on the woman’s face in front of all the participants, including dozens of doctors. The doctor’s wife, also a doctor by training, injected her with hyaluronic acid, after which the doctor performed laser peeling on her face using a laser gun on her cheeks and forehead.
According to the woman, shortly after the treatment she began to feel a burning sensation in her face, and the next day the situation got so bad that she could not open her eyes. According to her, her partner and the doctor advised her to take steroids and apply a cream, but although the swelling went down, scabs remained on her face, which turned into dark spots.
The claim: medical negligence
In the statement of claim, the woman claimed that she had become “a broken vessel” following the treatment, and was left with severe cosmetic and mental damage. According to her, she had to use heavy make-up every day in order to cover the scars and even renew it several times a day.
Attached to the lawsuit was an opinion by Dr. Amos Loyav, a plastic surgery expert, who stated that the woman’s skin peeling was carried out negligently and that the woman suffers from a 25% disability. The opinion stated that improper use of high laser intensities or a long duration of exposure could cause deep burns and spots, and that the doctor caused her “irreversible damage”, including extreme sensitivity to the sun. In addition, a psychiatric opinion was attached which stated that there is also Mental injury.
Attorney Ran Shapira, who represents the patient, told N12: “This is another shocking case in which a doctor performs treatments without any sufficient professional experience in the field and this at the expense of a patient who all she asked for was a simple aesthetic improvement and found herself with damages for the rest of her life,” he added that he hopes the court will rule in her favor and thus possibly prevent further cases in the future.
N12 contacted the accused doctor with the details of the lawsuit and he said: “After investigation, I am not aware of any lawsuit on the subject. If such a lawsuit is brought to my attention, I will study it and respond as usual.”
