Fight for billions: an artificial intelligence company is suing the Pentagon

According to a report in the Financial Times, the lawsuit was filed on the grounds that the government’s decision to classify the company as a “risk in the supply chain” could cause billions of dollars in damage to its revenues already this year.

The company went to a federal court in California on Monday and asked to declare that the classification – which is usually intended for suppliers from China and Russia – is “arbitrary” and “baseless”. In addition, the company asked the court to prevent the Trump administration from implementing the decision.

According to the company’s lawyers, the United States government “seeks to destroy the economic value created by one of the fastest growing private companies in the world.” It also states that “Anthropic’s reputation and its core liberties under the First Amendment are under attack.”

Rao added that the classification “could significantly damage market confidence and Anthropic’s ability to raise the capital needed to train the next generation of models”, and further noted that, “hundreds of millions of dollars in annual revenue could be at risk if customers interpret the Pentagon’s order in a restrictive manner”.

Last week the company announced that the “vast majority” of its customers will not be affected by the American move. Three of the company’s main partners – Amazon, Microsoft and Google – have announced that they will continue to maintain relations with Anthropic outside of the security field. So far, Anthropic has raised about 60 billion dollars, and its annual appropriated revenues are about 19 billion dollars.

According to them, security officials requested extensive rights to deploy the company’s models, while Anthropic insisted on protective mechanisms that it said were designed to prevent misuse. This dispute eventually led to the collapse of contacts and the declaration of the company as a risk in the supply chain. The classification, made official last week, requires companies to exclude Anthropic from their supply chains in military contracts. Trump also demanded that federal agencies stop using the company’s technology.

Artificial intelligence in classified activity

Following this decision, a group of more than 30 engineers and researchers from Google and OpenAI expressed personal support for Anthropic’s lawsuit in a document filed with the court.

According to the legal document, Hesset “began to demand that Anthropic completely abolish its usage restrictions and replace them with a general policy according to which the firm may make ‘any lawful use’ of the technology.” Amoday stated that he could not “wholeheartedly” agree to these conditions, which led to a dramatic breakdown in contacts between the company and the Pentagon.

Anthropic’s Claude artificial intelligence model is currently the only model in use in a classified operation, although rival company OpenAI late last month signed an agreement with the Pentagon to use its models in the most sensitive missions.

The Pentagon told the Financial Times: “As a matter of War Department policy, we do not refer to legal proceedings.”
