Netflix, subscription increases from 2017 to 2024 are illegitimate

The court of Rome has accepted the action brought against Netflix Italia and Consumer Movementascertaining the vexatiousness – and therefore the nullity – clauses that allowed the price of season tickets and other contractual conditions to be changed from 2017 to January 2024.

These clauses, in violation of the Consumer Codeallowed changes without indicating a justified reason in the contract. As a result, they were declared unilateral increases in season tickets are illegitimate applied by Netflix over the years 2017, 2019, 2021 and November 2024 (with the exception of increases relating to contracts stipulated after January 2024).

Who is entitled to a reduction in Netflix subscriptions?

Each subscriber will be entitled to one reduction of the current subscription priceat the refund of sums unduly paid and to the possible compensation for damage. The court also ordered Netflix to publish the content of the ruling on its website and in newspapers of national importance and to inform all consumers, including those who canceled their subscription, of the nullity of the clauses and of the right to a refund.

The decision – specify Paolo Fiorio and Corrado Pinna, lawyers who assisted MC in the case – concerns millions of consumers. It is estimated that, in Italy, Netflix has gone from 1.9 million customers in 2019 to approximately 5.4 million in October 2025. How to get Netflix price cuts

The ruling requires Netflix to also reduce the prices of current subscriptions to an extent equal to illegitimate increases. For example, a premium customer who activated the subscription in 2017 and who today pays 19.99 euros is entitled to the same service at the price of 11,99 eurowhile a standard customer who pays 13.99 will have to match 9.99 euro.

Possible class action against Netflix in case of failure to refund

“If Netflix does not immediately do so reduce prices ea refund customers – declares Alessandro Mostaccio, president of Consumer Movement – we’ll start one class action to guarantee all users the refund of the amount unduly paid“.

Netflix will appeal

“We will present appeal against the decision. At Netflix our members come first. We take it very seriously consumer rights and we believe that our conditions have always been in line with Italian legislation and practices”.
