Project proposals in industrial parks enjoy special investment procedures

According to Mr. Dung, in amending the law this time, the Government proposes to add regulations on special investment procedures. This is to shorten project implementation time, create favorable and competitive mechanisms and attract strategic investors. Accordingly, special investment procedures apply to projects in the fields of innovation, research and development (R&D); Semiconductor industry, manufacturing components, electronic circuits; High technology in industrial parks and economic zones.

Administrative procedures are also proposed to be reduced, the time for implementing procedures and processes is expected to be reduced by 260 days. Investors do not have to carry out procedures to obtain licensing and approval from management agencies in 3 time-consuming fields: construction, environment and fire prevention.

Explaining further, Minister Nguyen Chi Dung said “some amended regulations in the Investment Law have had very strong improvements”. He said that in addition to the content in the draft law, the drafting agency also proposed that all projects in all fields of investment in industrial parks, not just high technology and innovation, enjoy the “flow mechanism”. green”. That is, when investors register, they are considered for licensing within 15 days. After that, they do not have to carry out construction, environmental, or fire prevention procedures, but immediately deploy the project.

“We hope that this time with strong reform, projects in industrial parks, which have clearly defined planning, environment, and infrastructure, will be able to implement the green channel mechanism and special procedures,” Mr. Dung said.

Expressing his opinion, Vice Chairman of the National Assembly Nguyen Khac Dinh noted that “especially here, it is necessary to design a quick process, which does not mean just shortening the time and procedures”.

He analyzed that investors only need one set of licensing documents for all fields of environment, fire prevention and fighting… instead of one file for each aspect like today. The focal point for receiving and processing documents also needs to receive one contact, for example the Ministry of Planning and Investment, after 30-60 days to respond to investors.

“If the special procedure regulations are still as they are now, they are not special and not fast. Currently, investors have to go from one agency to another. Each agency has a set of documents, the time will last until a few years,” Mr. Dinh stated.

From the perspective of the inspection agency, Chairman of the National Assembly’s Economic Committee Vu Hong Thanh proposed that the Government consider limiting special procedures for a number of large, specific, pervasive projects that need to be implemented. now so as not to miss the investment opportunity.

Mr. Thanh also said that the decentralization of authority to issue special investment certificates requires a thorough impact assessment, ensuring that it meets the decision-making, organizational and human resource capacity of each management level.

Recognizing that a law amending four laws related to investment and planning are major problems, National Assembly Vice Chairman Nguyen Khac Dinh noted that the Government continues to review, to “remove what is really entangled.” , annoyed”.

“After the law is amended, it must open up new, better and faster things, but do not manage the State more tightly, making it more difficult for people and businesses,” he said, adding that amending this law will remove difficulties. but does not legalize violations.

It is expected that the Law amending and supplementing 4 laws related to investment and planning will be submitted to the National Assembly for consideration and discussion at the opening session on October 21.
