Revocation of license if rice exporter fails to report inventory

Traders doing rice export business must report to the management agency on the actual amount of rice in stock on a monthly basis.

According to regulations in Decree 107/2018, rice exporters must report to the Ministry of Industry and Trade on the actual amount of rice and rice in stock for each type. This is to synthesize data for administrative purposes.

In Decree 01/2025 recently issued by the Government, traders exporting this product only have to report to the Ministry of Industry and Trade and the Department of Industry and Trade on paddy and rice inventory on a monthly basis, instead of weekly as currently. onion. At the same time, they must send a copy of the report to the Vietnam Food Association to compile data. The new regulations will apply from March 1.

Businesses need to ensure mandatory rice reserves, meet technical standards on warehouses, rice milling facilities, and send periodic reports. Within 45 days of being licensed, the People’s Committee of the province or city must direct the Department of Industry and Trade to post-inspect warehouses, rice milling and processing facilities to meet actual business conditions.

However, in reality, many traders previously did not comply with the reporting regime in Decree 107, affecting rice exports.

Therefore, in the new decree, in cases of failure to comply with this regulation, the certificate may be revoked. Specifically, the Ministry of Industry and Trade will consider revoking licenses for businesses that do not submit reports after 45 days from the date this agency sends the urging document.

Authorities also revoked export eligibility certificates for traders who incorrectly declared warehouses, milling facilities, and rice processing facilities or committed other fraud to obtain licenses.

Also according to Decree 01, traders of all economic sectors, if they meet the conditions and are granted a certificate, have the right to do rice export business. However, these traders will only be entrusted or receive export entrustment from other traders that have certificates of export eligibility. This is a new point compared to the current regulations.

In fact, many businesses cannot meet the rice export business conditions, so they entrust units with a fee of 1-5 USD per ton of goods. That is, businesses with business eligibility certificates have the right to lease this paper and receive fees. This makes Vietnamese rice more expensive and more difficult to export, according to the Vietnam Confederation of Commerce and Industry (VCCI).

Thus, with the new regulations on consignment and consignment, rice exporters will not be able to lease certificates to export on behalf of ineligible parties.

Rice is an important commodity for Vietnamese agriculture. Statistics from the Ministry of Agriculture and Rural Development show that in the past 11 months, the rice industry has achieved impressive achievements when export turnover reached 5.3 billion USD, an increase of 22.4% over the same period last year. . This number not only exceeds the achievement for the whole year of 2023 but also sets a new record with growth of 10.8%.
