This time we have reached a question about a quiet residential area where a neighbor is constantly organizing garden parties.
Question: I live in a very quiet residential area, a dog barks here once a day for a few minutes. Unfortunately there is a neighbor who, as soon as it allows the weather, transforms its garden into a party zone, including the open air disco from noon to midnight.
He believes that he does not have to be considerate until 10 p.m. A conversation did not need success, he doesn’t care about the opinion of the residents. What would you advise? Police, complaint about the disorder or omission?
This time Nicole Neugebauer-Herl, lawyer from the law firm 1020, provided information on the living phone. She has the following legal response:
ANSWER: There are no legally defined rest periods, but it generally applies that neither should be excited in an unbearable way during the day nor at night or at night disturbing noise. If the personal conversation with the neighbor doesn’t help, I recommend calling the police if your neighbor celebrates a loud party again.

A noise disorder can be a criminal administrative violation. As your neighbor does not show himself to be insightful through a police operation, the civil lawsuit can also be taken with an injunction if the noise exceeds the customary location and thereby significantly affects the usual use of your property.
