They empower the CRT management to carry out tenders for the radio spectrum
The General Directorate of Spectrum Bidding of the new Telecommunications Regulatory Commission (CRT) will be in charge of carrying out the public bidding processes for frequency bands of the radio spectrum and orbital resources.
In addition, it will coordinate and manage the various phases and processes required and will keep a record of those interested in participating in the tenders. The above, in accordance with article 45 of section 5 of the Internal Regulations of the CRT, published yesterday by the Presidency of the Republic in the Official Gazette of the Federation (DOF).
The regulation establishes that this directorate will be in charge of preparing the bases for public bidding for concessions for the use, exploitation or exploitation of the radioelectric spectrum, as well as for the occupation and exploitation of orbital resources for commercial use, following the opinion of the general directorates of the CRT and competent authorities in the scope of their respective powers. The directorate will also be in charge of submitting to the approval of the plenary session of the CRT the issuance of calls for tenders as well as for the occupation and exploitation of orbital resources for commercial use.
The decree establishes that together with the Digital Transformation and Telecommunications Agency (ATDT), the bidding directorate will prepare the provisions on the assumptions and procedures through which concessionaires will be able to access discounts on the payment of contributions for the use, enjoyment, exploitation or exploitation of the radio spectrum, in exchange for coverage obligations in geographical areas and roads.
It must also incorporate the criteria that ensure effective competition in the provision of services and those that prevent concentration phenomena that contradict the public interest when carrying out the bidding processes.
