The ‘entrepreneur-saving’ rule on disputes over underpaid workers is back

The government is proposing the so-called measure again‘save-entrepreneurs’in the context of disputes betweencompanies e i underpaid workers. The rule was included in the latest draft ofDl PNRRexpected today in CDM. The measure had already appeared in the last budget law, during the parliamentary process in the Senate, but in the end it was removed, given the protests of the opposition and the social partners.

The employer, specifies the new draft of the text, “cannot be condemned to paysalary differencesor contributions for the period preceding the date of filing of the appeal initiating the judgment if he has applied thesalary standard previsto dal collective agreementstipulated or by contracts that guarantee equivalent protection pursuant to the public contract code for the sector and area in which the service is provided”. The provision, specifies the technical report, has a regulatory nature and does not, therefore, entail new or greater burdens on thepublic finance. The CGIL presses the executive: “The parliamentary majority and the Government seem to have a real obsession with reducing theworkers’ rights. For the third time the so-called entrepreneur-saving rule is being proposed again, a new and serious attack on salary and contribution protection”. Maria Grazia Gabrielli, confederal secretary of the CGIL, calls for the “definitive removal of the rule, which will be vigorously opposed in all forums”. While the leader of the M5S Giuseppe Conte speaks of an “obscene rule” which “deniesexploited workersand underpaid the right to recover thearrearsdespite a judge’s favorable ruling.”

Extension of PNRR monitoring structures
