The IRS lost the case and will return hundreds of millions of shekels to construction contractors.

The Haifa District Court’s Real Estate Tax Appeal Commission has ruled that the Tax Administration must refund the purchase tax paid to contractors who won “House Price” tenders.

The commission accepted the position of the contractors, who argued that winning the tender was not an acquisition of the right to real estate, but an agreement to provide construction services to the state.

The commission’s decision means that hundreds of construction companies are entitled to a refund of hundreds of millions of shekels in taxes paid in connection with New Resident Prices tenders.
