LaLiga expresses its “absolute disagreement” with the TAD sanction against Tebas and announces that it will appeal

LaLiga expressed its “absolute disagreement” on Friday with the public reprimand imposed on the club’s president, Javier Tebas, following the disciplinary proceedings for a “very serious” infringement that were opened against the president last July, a decision that they will now appeal, as they are “convinced that they have not committed any infringement.”

“LaLiga wishes to express its absolute disagreement with the resolution, which is considered null and void as it does not address all of the allegations presented. Furthermore, it considers that the resolution is based on facts that have not occurred and on an interpretation of the regulations that is not correct,” the entity’s statement said.

This is how LaLiga responded to the notification of the resolution issued by the Administrative Court of Sport (TAD), which has left the disciplinary file for a “very serious” infringement that it opened last July against Tebas as a “public warning”, according to the employers’ association this Friday.

The court’s file was related to a complaint made by Real Madrid following the urgent call by the leader of the Extraordinary Assembly of LaLiga in the summer of 2021 to discuss the agreement with the international fund CVC, which the Madrid club has been frontally opposed to from the beginning, even taking it to court.

The entity chaired by Florentino Pérez announced on August 10, 2021 that it had unanimously agreed to take legal action, both civil and criminal, against Javier Tebas and Javier de Jaime Guijarro, head of the CVC Fund, and against the fund itself, after the employers’ association confirmed the agreement for CVC to inject 2.7 billion euros into the competition and the clubs, all within the plan known as ‘LaLiga Impulso’.

At the same time, it also announced legal measures to annul the approval of the agreement at the Extraordinary General Assembly held two days later. The Madrid club denounced that the Assembly was called eight days in advance, instead of the required 10 days, using the urgent procedure.

“The urgent call was made as a result of the Delegate Commission and after the meeting was held, with the authorization of the Legal Department, all in accordance with article 45.e) of the Statutes and following the same formalism applied for decades, which does not establish the need to include the motivation for the urgency in the call,” LaLiga defended.

The club’s association also warned that this was not the first time that they had called an Assembly using this urgent procedure, “under the mandate of different presidents and without any opposition from Real Madrid until that date.” “It is, therefore, a consolidated action, which had never been questioned by the clubs. Therefore, from the point of view of LaLiga, there is no infringement in Tebas’ conduct,” he added in his arguments.

LaLiga also reported that the president “has the clear support of the Executive Committee and the vast majority of clubs,” after 37 of the 42 entities initiated proceedings to appear in the case as affected parties.

“This resolution is not final. LaLiga remains convinced that it has not committed any infringement, and will therefore file the relevant appeals in order to obtain the nullity of the sanctioning resolution, as has already occurred with other legal actions taken by Real Madrid against agreements approved legitimately and with an almost unanimous consensus by the competent bodies of LaLiga,” the statement concluded.
