Justice supports LaLiga to block IP addresses that distribute ‘pirate’ content

The Commercial Court No. 6 of Barcelona dismissed on Wednesday the applications for annulment of actions submitted by Cloudflare and Rootedcon, among others, against the final judgment issued on December 18, 2024, which ordered the blockade of IP addresses used for the illegal distribution of audiovisual content of Laliga, as reported by the employer in a statement.

This resolution, before which there is no appeal, legally supports the initiatives undertaken by LaLiga and Telefónica in the fight against fraud and audiovisual piracy in Spain. According to the employer’s statement, the resolution reaffirms that the action exercised “fits law and is covered by current legislation on intellectual property and services of the information society”, ratifying the validity of the procedure.

In fact, it is ruled out that there has been a “procedural artifice” as some applicants suggested, and the validity of the procedure followed is ratified, discarding the judicial order that there is an indiscriminate blocking procedure expressly stating that there is no “decrease of guarantees.”

As reflected in the car and communicates LaLiga, “it is not accredited, the arguments made by the various petitioners, which has occurred any damage, nor is it identified, nor is it quantified, nor is the practice of any evidence aimed at proving, directly or indirectly, the generation of damage as a constituent element of the annulment claim.”

That is, there was no real accreditation of the existence of damage due to the execution of IPS addresses. Therefore, the sentence maintains its validity and the execution of IPS blockages of ‘pirates’ resource detected on the Internet during the issuance of LaLiga matches, including Cloudflare IPS, can be followed.

With this decision, the Judiciary “gives a boost to the strategies for the defense of audiovisual rights developed by LaLiga and Telefónica, who act within the legal framework to safeguard their contents against piracy practices that undermine the sustainability of the sector.” This sentence, highlighted the employer, supposes a “new firm step” towards a more fair and legal digital environment for the creators and rights holders in Spain. ”
