The TSJM annuls the Atlético Sports City project after detecting irregularities

The Superior Court of Justice of Madrid (TSJM) has annulled the Atlético de Madrid Sports City project, considering that its administrative processing violated several essential principles of the procedure.

In the resolution, to which Europa Press had access and advanced by ‘Cadena Ser’, the Chamber considers an appeal against the agreement of the Plenary Session of the Madrid City Council, of October 2024, by which it approved the ‘Olympic Park Special Plan West Sector’, of the San Blas-Canillejas district. Thus, the magistrates agree to declare its nullity, which leaves urban planning paralyzed.

This project involves the creation of a large sports, leisure and nature complex around the Cívitas Metropolitano stadium, in the San Blas-Canillejas district. It is planned to occupy around 265,000 square meters of equipped surfaces.

“The modification established by the special plan should have been processed by a modification of the general plan and not by such instrument, determines that in any case said modification should have been submitted to the strategic environmental evaluation in some of the modalities provided for in said application regulations,” he points out.

The court appreciates that the Administration did not adequately justify the public interest of the development nor did it prove compliance with the urban planning requirements demanded by current regulations.

The Chamber concludes that the challenged action lacked “sufficient motivation” and presented deficiencies in the reports that should support its approval. These deficiencies, affirms the Chamber, “prevent the validity of the agreement from being sustained” and force the proceedings to be withdrawn.

He concludes that “this motivation” was not “sufficient and appropriate to justify that a modification like the present one be formalized through a special plan.”
