The TAR rejects the stadium-clinic project in Terni. Ternana football club searched

Administrative judges have Stadium/Clinic project rejectedbut the ‘war’ of stamped papers between Terni and the Umbria Region will continue up to the Council of State. The investigation started after the complaints presented by the Rizzo family. At the center of the maxi investigation is what happened in the entire period between June 2024 and September 2025, before the helm of the club passed into the hands of Claudia Rizzo, patron of the Umbrian club. Including the period from 15 June to 15 September, when the company was in a bind, because it was formally administered by the previous managers, but in fact stripped of their powers because they had issued a power of attorney to sell for the benefit of men close to Massimo Ferrero.

The investigation includes the former super consultant of the football club Ferrero (formerly president of Sampdoria), and the former sole director Tiziana Pucci. For them, financial infidelity is hypothesized, a crime committed when – directors or other top figures – intentionally cause financial damage to the company to obtain an unfair profit for themselves or others” and is punished with imprisonment from 6 months to 3 years.

The project and the Region’s opposition

The demolition and reconstruction project of the Edmondo Liberati Stadium in Terni is viewed with interest by the Umbria region, but the Health and Welfare management of the same regional body has been opposing for some time the authorization for the construction of the so-called Stadium/Clinic within the structure, as is inherent in the project presented by the municipality of Terni and the historic football club.

The appeal to the TAR and the first decision

Thus, the matter ended up before the administrative judges (Tar) of Umbria, with a first result that occurred on March 24th. The judges declared the appeals presented by the company inadmissible Ternana Football and from Ternana Women Srl and they annulled the municipal resolution contested by the Region.

Glimmers opened by the sentence

But the sentence, between the lines, opens anyway glimmers for the realization of the project on which the Council of State could decide in the future. And that is, first of all there is the fact that the opinion of the Regional Health and Welfare Directorate at the service conference should be interpreted as simple observations and conditions, but not with a real denial.

Then again: the opinion of the Regional Health and Welfare Directorate would not have taken into consideration the compatibility of the project with respect to the needs of the territory, an aspect which would constitute the only element that can be assessed, pursuant to the relevant legislation, for the purposes of consenting to the authorization for the construction of the healthcare facility.

Furthermore, – according to the administrative experts -, the dissent of the regional offices would therefore appear to refer to issues that were not the subject of the conference, furthermore, “the opinion would also be illegitimate for not having considered the reality of the Terni area, which is completely devoid of private clinics”, we read in the documents.

The hub of beds and services in the area

In fact, the very situation represented in the main appeal by the Region would conflict – according to what the lawyers of the municipality of Terni have highlighted – with the state of fact, since for the Province of Terni 80 beds have been made available under the accreditation or agreement regime and another 42 private places.

And, from here, it would also be in contrast with the criterion of proximity services which regulates public welfare services, thus creating a territorial imbalance between the Province of Terni and that of Perugia.

A game still open until the Council of State

On the other hand – the lawyers further point out -, “the same expert consulted by the Regional Health and Welfare Directorate would have confirmed the possibility of issuing the authorization for the construction of the health facility during the services conference”. Also for this reason, therefore, the Stadium/Clinic issue appears far from closed, awaiting the ruling of the Council of State.
