According to Mr. Linh, priority, restricted and prohibited technologies for transfer are being developed by the Ministry of Science and Technology in the draft amending Decree 76/2018/ND-CP of the Government detailing regulations and instructions. Encouraging the transfer of emerging technology, according to Mr. Linh, aims to match the continuous development trend of science and technology over the past many years. With limited technology transfer, the drafting committee proposed reducing applied technologies for environmentally friendly purposes but with low efficiency. Specifically, solar batteries with an efficiency of less than 20%, although applied to environmentally friendly products, will limit transfer. In the draft amendment to Decree 76, the Ministry of Science and Technology proposed to ban technologies considered old and outdated such as 1G, 2G and illegal technologies such as creating malicious code and computer viruses. Currently, the Ministry of Science and Technology is developing, amending and supplementing Decree 76 and will soon submit it to the Government in the near future.

In addition, the Ministry of Science and Technology is developing a draft to amend and supplement Decree 95/2014/ND-CP regulating investment and financial mechanisms for science and technology activities. Mr. Nguyen Nam Hai, Director of the Department of Financial Planning, Ministry of Science and Technology, said that the drafting agency aims to remove 3-4 groups of policies on financial mechanisms. The draft aims to remove obstacles in the use of regular funding sources for investment in procurement infrastructure and research infrastructure of academic institutions.

The revised Decree 95 also adjusts the use of the Science and Technology Development Fund by enterprises in a more expanded direction, based on the needs of the unit that has set aside the fund. The use of the fund is not only for R&D activities but also for technological innovation, innovative start-ups… This is expected to remove difficulties for businesses’ science and technology development funds being left over. trillions of dong because there is no mechanism to use it.

Regarding the shortcomings in the financial mechanism for scientific research activities, according to Mr. Hai, they will be resolved when the Ministry of Science and Technology advises the Government to amend the Law on Science and Technology issued in 2013. According to him, Hai, the revised and supplemented Decree 95 is expected to be submitted to the Government this October. However, amendments to Decree 95 must be synchronized with the Government’s issuance of a decree guiding procedures for estimating and finalizing regular expenditures for procurement activities, which are currently in the consultation process.
