Unlike parole, which allows defendants to go free if they meet certain requirements, such as maintaining employment or paying restitution, unconditional parole will come with no strings attached. This sentence, Judge Marchan wrote in an 18-page decision, “seems to be the most applicable solution to ensure finality and allow the defendant to exercise his appeal options.”
Trump, who can ask the appeals court to intervene and delay the sentence, faces up to four years in prison. A Manhattan jury convicted him in May of 34 counts of falsifying business records, saying he tried to cover up a sex scandal that threatened to derail his 2016 presidential campaign.
Judge Marchan on Friday refused to overturn the jury’s decision, rejecting Trump’s claim that following his election victory, his conviction should be overturned. Last month, the same judge rejected another claim that Trump raised in hopes of getting the case dismissed: “His conviction violated a recent Supreme Court ruling that grants presidents broad immunity for their official actions.”
“Dismissing the indictment and overturning the jury’s decision will not serve the concerns raised by the Supreme Court in the limited number of rulings dealing with presidential immunity, nor will it serve the rule of law,” Judge Marchan wrote in the decision. “On the contrary, such a decision would undermine the rule of law in a way that cannot be measured.”
