The The United States Supreme Court has dealt a severe setback to President Donald Trumpestablishing that for the time being will not be able to proceed with the deployment of the National Guard to the Chicago area. In an unsigned order cited by the Washington Post, the justices said that the ability to “federalize” the National Guard applies only in “exceptional” circumstances and that, at this time, the government has not indicated a legal basis that would allow the military to enforce laws in the state of Illinois.
What does this decision mean
Three conservative justices – Samuel Alito, Clarence Thomas and Neil Gorsuch – dissented. The decision, while tentative, is likely to have a trickle-down effect, calling into question Trump’s strategy of deploying federal troops in several other cities, including Los Angeles, Portland, Washington, San Francisco and Baltimore, despite opposition from local and state authorities.
The Chicago case represents the Supreme Court’s first intervention into the Trump administration’s attempts to deploy the National Guard to urban areas. Previously, federal judges had already blocked similar initiatives in Chicago and Portland, while other disputes remain open.
