Tech Trial of the Century Nears End: Ruling in Musk-OpenAI Future of AI Dispute

The lawsuit was filed by Musk, the richest man in the world and the founder of of the competing model of artificial intelligence, Grok. He sued OpenAI, its CEO Sam Altman and president Greg Brockman, claiming the company had deviated from its core mission of developing safe and useful artificial intelligence. The outcome of this case could have far-reaching consequences not only for OpenAI, but also for OpenAI. and for the entire technology industry.

Accusations of betrayal and greed

Musk, who was not present in court on Thursday because he is on a diplomatic visit to China with US President Donald Trump, claims that Altman and Brockman “hijacked the charity” and turned it into a get-rich machine. His attorney, Steven Molo, used his closing arguments to accuse OpenAI of breaching a charitable trust, saying they enriched investors and themselves at the expense of the nonprofit’s mission. Defense of OpenAI: Musk sued out of envy

OpenAI’s lawyers countered with arguments, claiming that Musk waited too long to file a lawsuit for allegedly violating the founding agreement. Part of the defense team, attorney Sarah Eddy, suggested that it was actually Musk who was unreliable.

She added that by 2017, everyone associated with OpenAI, including Musk, who was still on the board at the time, knew that the company needed significantly more money to fulfill its mission than it could raise as a non-profit organization. Eddy also indicated that Musk himself hoped to profit from the company, and according to reports from the trial, Altman testified that Musk at one point demanded a 90 percent stake.

​- Mr. Musk wanted to turn OpenAI into a profitable company that he could control. But other founders refused to hand over the keys to general artificial intelligence (AGI) to one person, let alone Elon Musk – she said.

The key issue of obsolescence and the impact on the future

The question of whether the lawsuit was filed within the legal deadline, or whether the statute of limitations has expired, could turn out to be crucial. Judge Yvonne Gonzalez Rogers wrote in a court filing last month that “if the jury finds that Musk did not file a lawsuit within the statute of limitations, it is very likely” that she “will accept that decision and enter a verdict in favor of the defendants.” If the jury does decide that the lawsuit is timely, it will have to decide whether OpenAI had a “charitable trust” and whether the company and its executives betrayed it.

The whole case takes place against the backdrop of an intense race in the development and commercialization of artificial intelligence. The outcome could significantly affect OpenAI’s plans for an initial public offering (IPO), which is expected to be one of the largest in history.
