Why Trump’s ordinance was rescinded

Trump’s order, according to the judges, violates the 14th Amendment of the Constitution, which establishes that all persons born or naturalized in the United States are American citizens. Thus, the ‘ius soli’ remains, which had been in force since July 9, 1868, when the 14th Amendment was officially introduced into the Constitution.

Chief Justice John Roberts led the majority in upholding the ruling: “Those children are therefore subject to the jurisdiction of the United States. They satisfy both elements of the Citizenship Clause: they are ‘born in the United States’ and ‘subject to the jurisdiction thereof,'” he wrote. Therefore, “according to the Constitution, they are citizens at birth.”

The verdict passed 5-4. Sonia Sotomayor, Elena Kagan, Amy Barrett and Ketanji Jackson spoke with Roberts. Ultra conservatives Clarence Thomas, Sam Alito and Neil Gorsuch are against. Halfway there was Brett Kavanaugh who partly agreed and partly didn’t.
