The Milan Court of Appeal, business section, has the second request was also rejected to suspend the decree on the shutdown of thehot area of the former Ilva of Taranto, request made by the companies Ilva and Acciaierie d’Italia, both in extraordinary administration. This was announced by legal sources of the citizens of Tarabto who formed against the former Ilva. The decision was filed today and follows a hearing on September 30.
The two companies had renewed the request for suspension for the stop decree issued on 27 July by the same Court of Appeal and now close to the expiry of 90 days, since on 20 October the Court of Cassation will give its opinion. In fact, the extraordinary appeals against the decree presented in August by Ilva and AdI are before the Supreme Court.
The judges: health protection remains prevalent
“Regardless of the assessments of merit made with the aforementioned decree 425/2026 and which remain extraneous to the present proceeding, it is believed that, even in this eventuality (the shutdown of the blast furnaces), the protection of the right to health is still prevalent, in due respect of the interpretation given at the community level, as well as of the same constitutional provisions of domestic law”. The Court of Appeal of Milan, companies section, says this in the 11-page provision with which today it rejected the requests asking to suspend the decree on the shutdown of the hot area of the Taranto steelworks (decree 425/2026) until the ruling of the Court of Cassation which will hold the hearing on the case on 20 October.
The judges of the Board of Appeal – president Giuseppe Ondei – they cite article 41 of the Constitutionas amended by constitutional law n.1 of 2022 where it provides that “private economic initiative cannot be carried out in such a way as to cause damage to health or the environment”.
Former Ilva, first request for suspension rejected on 11 September
In Milan the Court of Appeal had already rejected a first request for suspension on 11 September (hearing on 9 September) and in recent days the General Prosecutor’s Office at the Court of Appeal had renewed its no to the suspension in view of the hearing on 30 September. No expressed by the Prosecutor’s Office through a non-binding opinion for the college of judges. For the next hearing in the Supreme Court, the opinion of the Attorney General is now expected to be filed with the Supreme Court by 5 October.
However, regardless of the decisions of the magistrates, the former Ilva in Taranto is still heading towards a shutdown within days by pre-heating – i.e. at minimum without producing – even the few plants left in operation. This is because the raw materials (minerals) which were no longer ordered after the provision of 27 July by the Court of Appeal which ordered the stoppage, to be implemented upon expiry of the 90 days granted and therefore by 26 October, are now finished.
The plants then stop because there are no more raw materials and ordering them again, in addition to requiring the company to have economic resources, also requires time, given that the same raw materials arrive from abroad by ship to Taranto. The stop of the plants will also lead the company to communicate a increase in layoff numbers. Currently there is authorization from the Ministry of Labor for 4,500 redundant workers in the AdI group, of which 3,800 in Taranto.
