The battle over the inheritance tax between the Government and the Senate will be examined by the Constitutional Court

The Plenary Session of the Constitutional Court has admitted to proceedings this Tuesday the conflict between constitutional bodies promoted by the Government of Pedro Sánchez in front of the Senate – Chamber in which the Popular Party has an absolute majority – in relation to an agreement of the Table of November 21, 2023by which the bill repealing the Inheritance and Donation Tax is taken into consideration for processing, against the discretion of the Executive.

The Government stated that the agreement of the Upper House Board could imply a violation of the articles 134.6 of the Constitution and 151 of the Senate Regulationsin relation to the exercise of the power of budget veto.

The admission to the process of the conflict of powers agreed this Tuesday by the court of guarantees It does not paralyze the processing of the norm. According to legal sources, the professor of Constitutional Law María Luisa Balaguer, a member of the majority sector of the body, has been a speaker on the matter.

Article 134.6 of the Constitution states that “any proposal or amendment that involves an increase in credits or a decrease in budgetary income require government consent for your processing.”

Last December, the Popular Party announced this proposal to eliminate the Inheritance and Donation Tax in all the autonomous communities of the country. Many of the regions They have it discounted between 99% and 100%. It remains in Castilla-La Mancha, Navarra, Asturias and Catalua, reports Servimedia.

The total elimination of the Inheritance Tax, transferred to the autonomous communities, would force the State to compensate them for the money they stop collecting, according to the proposed law appealed by the Government. According to the Executive’s own estimates, around 2.8 billion euros are collected from this tax, which according to the PP represents 1% of tax collection.
