Francisco Franco Foundation asks Culture to inform it if the administrative route for its extinction has been exhausted

The Francisco Franco Foundation has asked the Ministry of Culture to report whether the administrative route has been exhausted in the process opened by the department he directs Ernest Urtasun to urge the extinction of the entity.

This has been made known by the President of the FNFF in a letter addressed to the Minister of Culture to which Europa Press has had access and in which they explain that after the signing of the resolution by the minister on April 14, They would not have been informed whether or not the administrative procedure was “put to an end.”

“However, the content of said agreement does not contain an express indication of the appeals against it, nor does it specify whether said act puts an end to the administrative procedure, in the terms required by Law 39/2015, of October 1, on the Common Administrative Procedure of Public Administrations,” explains the FNFF.

The entity asks to know that, if the administrative procedure is not put to an end, “what administrative appeal should be filed, specifying whether it is an appeal or reconsideration appeal”, as well as the period within which said appeal must be filed

Urtasun announced on April 14 that it had signed the resolution that puts an end to the administrative procedure that will allow it to formally request before the judicial authority the “definitive” extinction of the Francisco Franco National Foundation.

This was stated in a press conference held at the Ministry of Culture in which he explained that the file includes legal reports, content analysis and testimonies from victims of the Franco regime that concluded that the entity “does not fulfill purposes of general interest” and develops activities and messages that involve “contempt and humiliation” of the victims, violating their right to truth, justice and reparation.

“The result is a solid, rigorous, and legally well-founded file. And now the final decision is in the hands of a judge. But the Government considers that the legal causes for its extinction clearly exist, and we say it clearly. We are, with the law in hand, protecting the dignity of the victims, because that is our responsibility“, underlined Urtuson.

The minister recalled that the Democratic Memory Law, in its fifth additional provision, provides for the extinction of those foundations that do not pursue purposes of general interest or carry out activities contrary to them.
