La Jornada: The Supreme Court attracts a review of the veto on the definitive release of Frida Kahlo’s works

The Supreme Court of Justice of the Nation (SCJN) will review whether it maintains the presidential veto that, since 1984, prevents the definitive export from Mexico of the works of Frida Kahlo Calderón, even if they belong to individuals.

By a majority of eight votes, yesterday the plenary session exercised its power to resume jurisdiction over the protection under review 40/2026, promoted by the Banco ve por Más, after in 2024 the National Institute of Fine Arts and Literature (Inbal) refused to permanently remove the work from the country. “This matter has the potential of this new integration of the Supreme Court: to rule on issues of national relevance regarding the right to culture versus the right to property,” said Minister Giovanni Figueroa Mejía.

The only minister who voted against the resumption of jurisdiction was María Estela Ríos González.
