The PSOE asks in Congress to protect minor influencers, a norm in which Yolanda Díaz and Urtasun work

The PSOE has registered in the Congress of Deputies a non-law proposition (NLP) for which urges the Government to create a specific legal framework for the economic activity of minors on social networks that guarantees its protection.

This is a rule that the Minister of Labor and Social Economy, Yolanda Díaz, and the Minister of Culture, Ernest Urtasun, are already working on as part of the Royal Decree that is part of the Statute of the Artist and which will regulate the labor relations of artists, technicians and assistants in the field of performing, audiovisual and musical arts. Urtasun has assured that the norm will see the light “in the coming weeks.”

Last January, sources from the Ministry of Labor and Social Economy explained their desire to force minor influencers or influencer parents who regularly show their children on social networks promoting brands to sign a contract with the firm they are promoting.

The norm, which the Executive expected to approve at the latest after the summer, It will regulate the work of minors on social networks, limit generative Artificial Intelligence (AI) and make the figure of the privacy coordinator mandatory in filming.

But specifically in matters of minors, the text specified that if there is no employment contract between the child and the company shown on social networks, the Labor Inspection and the Prosecutor’s Office may act. The Royal Decree regulates the specific regime for the participation of minors in artistic activities and their authorization, improving their rights and establishing “clear and unique” rules for the entire territory, avoiding abuses or unfair competition between companies.

In this sense, the Royal Decree excludes work at home or self-employment for minors, so only work as an employee is permitted, and minors will have maximum hours depending on their age; Priority will be given to ensuring that they can continue with their educational training and that they have leisure and life time.

Now, the PSOE has registered an initiative for debate in the Plenary of Congress, to “protect minors against ‘sharenting’ for commercial purposes and the economic exploitation of your image in digital environments“.

In this sense, they ask – in addition to the creation of a specific legal framework – for clear limits on the use of the image and life of these minors for commercial purposes, adapted authorization and supervision mechanisms and effective, transparent and guaranteed protection of the income generated in their name.

The PSOE has also asked that consideration be given to studying the establishment of express safeguards; guarantee the right to progressively participate in decisions; training campaigns for families; and work, within the European framework, to advance the co-responsibility of digital platforms in the protection of children.
