A turn in the energy industry’s million-dollar dispute | Trade magazine

The Supreme Administrative Court (KHO) has decided to suspend the implementation of the decisions made by the Market Court in autumn 2025.

The energy company informs about the matter TWO and the grid company Fingrid.

The Supreme Court’s decision concerns market law solutionin which it returned the matters concerning the amount of payments and the basis of determination of the so-called system protection dispute to the Energy Agency.

During the enforcement ban, the Energy Agency’s old regulations in the matter will be followed. The ban on enforcement lasts until the Supreme Court has decided the matter definitively or ordered otherwise in the matter.

This is what it’s all about

System protection is about the fact that, according to Fingrid, the Finnish electricity grid cannot withstand a sudden shutdown of the Olkiluoto triple reactor. The reactor has an output of 1,600 megawatts, while Fingrid has set the limit value of the electricity grid at 1,300 megawatts.

According to TVO’s press release, Protection is implemented in practice, for example, by controlling industrial consumption and with the help of battery plants. If the protection system is not in full use, the power of OL3 has had to be reduced from time to time at Fingrid’s request.

According to TVO, this can happen, for example, when industrial plants participating in the protection system are out of service.

The Energy Agency decided in December 2024 that Fingrid, which is responsible for system protection, has the right to charge TVO for the main part of the costs caused by the protection as a service fee. Part of the costs would have been borne by Fingrid.

Fingrid has estimated that system protection would bring costs of 100 million euros per year. TVO has estimated the price at 40 million euros per year.
