Allegations of violation of the law on market competition

At the heart of the class-action lawsuit, known as Caccuri v. Sony Interactive Entertainment, is a claim that Sony illegally created a monopoly in the digital PlayStation game market. Prosecutors allege that a key move was Sony’s decision in 2019 to stop allowing third-party retailers, such as Amazon or other digital key sellers, to sell vouchers for specific digital games. That move, according to the lawsuit, eliminated competition and forced players to buy digital versions of games exclusively through the official PlayStation Store, often at higher prices.

This topic has become even more relevant in recent months considering Sony’s plans to completely switch to digital distribution and exit the physical media market by 2028. Gamers are concerned that such developments will further strengthen Sony’s monopoly and limit their choices.

Settlement and payment to users

Although Sony continues to deny any wrongdoing and rejects claims that it harmed its users, the company has agreed to a settlement to avoid further costs and the uncertainty of litigation. The court has not yet ruled on whether the company actually violated the law, but it has preliminarily approved a settlement of $7.85 million. The final deadline for approving the settlement is scheduled for October 15, when it will be decided on the method of distribution of funds, confirm the final amount and cover legal expenses.

Who is entitled to compensation?

Citizens of the United States of America who purchased certain digital games through the PlayStation Store between April 1, 2019 and December 31, 2023 could be entitled to a portion of the compensation. Qualified users with an active PSN account should have funds deposited directly into their account. Those who have deactivated their accounts in the meantime can request a cash payment by sending proof of purchase to the official e-mail address of the settlement.

As is common with these types of class action lawsuits, the exact amount that individuals will receive will not be known until payments begin. It will probably only be a few dollars, but as stated in the original article, free money is free money.

Problems are piling up outside the US as well

This is not the only legal problem that Sony is facing. In the United Kingdom, a much larger lawsuit is underway, weighing almost two billion pounds (about 2.7 billion dollars), and covering almost 12.2 million British users. The lawsuit accuses Sony of abusing its dominant market position by charging a 30 percent commission on all digital sales, leading to a “money grab” from consumers. Meanwhile, in another lawsuit in California, PlayStation has admitted that the games don’t actually own their digital games. Although the term “license” is often mentioned in the terms of use, this recognition resonates badly with the public at a time when the company is preparing for a completely digital future.
