CEOE asks that the Artist Statute balance worker protection and economic viability and avoid more bureaucracy

The Spanish Confederation of Business Organizations (CEOE) has positively valued the development of the Artist Statute although he has claimed that his advance guarantees “a proper balance between the protection of workers and the economic viability of companies” and to avoid a “disproportionate” increase in bureaucratic burdens.

This Tuesday, the Council of Ministers approved the Royal Decree regulating the special employment relationship of artists who carry out their activity in the performing, audiovisual and musical arts, as well as people who carry out technical or auxiliary activities necessary for the development of said activity.

In this regard, the entity, in statements sent to Europa Press, recognizes that the standard responds to a “historical” demand from the cultural and creative sector and incorporates instruments that can contribute to providing greater legal security to certain labor relations and favor “a framework more adapted to the singularities of the artistic employment“.

“The adaptation of the labor and Social Security framework to the particularities of artistic activities constitutes a relevant step to improve the protection of professionals and adapt the regulation to the reality of a sector characterized by intermittency, temporality and the diversity of forms of service provision,” said the CEOE.

In this sense, the entity considers it a priority to guarantee that the new administrative and documentary obligations do not represent a “disproportionate” increase in bureaucratic burdensas well as that the standard has clear interpretative criteria that allow a homogeneous application and avoid situations of legal uncertainty.

Furthermore, he has defended that new contracting mechanisms retain the necessary flexibility to adapt to the intermittent nature of artistic activity, in addition to evaluating the economic and organizational impact that the new obligations may have on companies, promoters, producers and cultural entities.

Finally, CEOE has opted to maintain a permanent dialogue with economic and social agents during the implementation of the standard to identify possible adjustments that facilitate its correct application. In this sense, it has assured that it will continue analyzing the regulatory development and its practical application with the aim of contributing to a regulatory framework that combines the protection of professionals with competitivenessjob creation and the growth of cultural and creative industries.

For its part, the Association of Women Filmmakers and Audiovisual Media (CIMA) celebrates the incorporation of the figure of privacy coordination and the reinforcement of protocols against harassment.

“These are important steps to ensure safer and more respectful filming. We will continue working so that these measures are applied rigorously and that privacy coordination professionals have the appropriate qualifications,” the entity assures Europa Press.
