Israel’s Ministry of Justice warns that publishing AI images could lead to lawsuits

In the published draft, the Ministry of Justice warns that such publication may qualify as copyright infringement, especially if the results are similar to the protected works on which the models were trained.

Although the opinion is intended for government agencies, its legal implications are relevant to all users of AI platforms.

“When output is generated from self-instruction for AI, there is a risk that it will resemble the copyrighted works of third parties, particularly those on which the system was trained, which could amount to copyright infringement,” said the opinion, written by Ayelet Feldman, Howard Poliner and Odaya Gahali-Schwartz of the Civil Division of the Office of Legal Counsel.

Publishing such materials without the consent of the copyright holder is a violation of copyright law and may result in a civil suit and compensation of tens of thousands of shekels.

Recommendations of the Ministry of Justice

Give preference to AI platforms that are trained on publicly available or licensed works, or that guarantee safe use of the results.

Include in the task for the AI ​​instructions that exclude the generation of a result that violates copyright or is similar to a protected work.

Check the result before publishing. It must not be similar to a protected work. It is recommended to ask the chatbot about sources of inspiration and check the similarities using an online search or specialized tools.

Record considerations taken into account when using the work, including prompts.

Provide the opportunity for copyright holders of content to remove it and promptly consider requests.
