About the assets of the Phoenix – Personal & Logistics GmbH based in Leoben, bankruptcy proceedings were opened at the Leoben regional court on July 16th. They gave that AQUA and the KSV1870 announced on Thursday. 93 employees and around 40 creditors are affected by the insolvency.

In addition to its headquarters on Straußgasse in Leoben, the company, which specializes in temporary employment, has other locations in Judenburg, Kapfenberg and Vienna. Of the 93 employees, 83 are currently being hired out to various customers.

Debts and assets

According to KSV1870, the liabilities amount to around 2.62 million euros, which are offset by assets of around 624,800 euros. The over-indebtedness therefore amounts to almost two million euros. The assets mainly include outstanding customer receivables and the company’s vehicle fleet.

Already the second bankruptcy

The causes of bankruptcy are currently unknown. The managing director of the company, founded in 2011, is Armand Beram, the sole shareholder of Weiss Logistik Center BetriebsgesellschaftmbH. Phoenix had to file for bankruptcy back in 2017, and the process was canceled after a restructuring plan was approved.

Future unclear

The court appointed lawyer Gernot Prattes from Bruck an der Mur as insolvency administrator. “The insolvency administrator will now have to check whether continuing the company is in the interests of the creditors,” says Herma Jonke from KSV1870. It is currently unclear whether the company will be restructured or liquidated.

The registration deadline for creditors’ claims ends on August 26th, and the reporting and audit meeting takes place on September 9th.
