Supreme Court overturns Trump’s order restricting birthright citizenship

The US Supreme Court overturned Trump’s order limiting the right to US citizenship by birth, signed in January 2025. Six judges voted for the repeal of the decree, three were against.

Lawsuits against the decree immediately after its signing were filed by several US states and cities where representatives of the Democratic Party are in power.

The principle of birthright citizenship is enshrined in the first sentence of the 14th Amendment to the US Constitution. It states, in part, that “all persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State in which they reside.”

Donald Trump himself defended the decree by saying that foreigners were abusing “maternity tourism.”
