The Be’er Sheva District Labor Court upheld the claim of a girl who was injured while commuting to a party hall where she worked as a bartender, and ordered the National Insurance Institute to take into account the tips she received in cash when calculating the amount of temporary disability benefits.
Based on the girl’s salary sheet, she was given an allowance of 2,300 shekels per month. The girl insisted that her real income was significantly higher, since she received tips worth about 300 shekels in cash per shift.
In court, other bartenders and the employer corroborated her account of receiving tips, and the court ruled that the fact that they were not included in the payroll did not mean that they were not part of the income when calculating entitlements.
