INPS recognizes the right to Naspi for those who are forced to resign from work due to violence and persecutory acts. The institute communicates this, underlining that “guaranteeing safety and social protection means offering concrete supports capable of safeguarding the lives and autonomy of those who find themselves in vulnerable conditions. Economic independence represents a fundamental pillar to allow any person to escape risky environments”.

For this reason “the INPS draws attention to an essential protection: the possibility of accessing Naspi, the unemployment benefit, even in cases where resignation is inevitable to safeguard one’s safety”.

The INPS message: violence equated with just cause

With the recent operational indications contained in Message number 2540 of August 3, 2026, the Institute clarifies that the violence and persecutory conduct – even if coming from subjects outside the professional environment – may determine an objective impossibility to continue working activities. “For every worker who suffers such episodes – he underlines – the choice to interrupt the employment relationship does not constitute a free decision, but an act of self-defense“.

The law and INPS recognize this condition as involuntary unemployment, equating it in all respects to resignation for just cause due to the actions of a third party, thus guaranteeing the right to financial support without penalty.

Requirements, protection of women and priority lanes

The recognition of the performance requires that objective and documented situations occur: it is necessary to verify that the actions suffered have compromised psychophysical balance of the person or their daily safety, as in the case of harassment or threats along the home-work journey that make it impossible to reach the workplace safely.

Given the centrality of the contrast to violence against women, INPS consulted the Ministry of Labor and Social Policies, who, recalling the Recommendation of the Council of Europe for the protection of victims, confirmed that the resignation due to gender violence they fully fall within the protection of innocent unemployment. This recognition applies in the presence of an effective connection between the oppressive behavior suffered and the working context, guaranteeing a concrete protection of health, dignity and protection of workers.
